the determination and hard work of the Board of Directors, spear headed by Cheryl Poage, we are elated to report the following. The court has rendered a judgement in favor of the Crystal Lakes Road
& Recreation Association. The Association and its' Membership proved prescriptive use for the Bear Gulch Easement and therefore have the right to utilize the easement. Access is currently limited
to equestrian, hiking and biking, OHV access will require permission granted by the Roosevelt National Forest. The "fight" is still not over, we have 120 days to get a surveyor back to the area to
preform another survey for a metes and bounds description to append to the court order. The Association was awarded litigation expenses which include; expert fees, deposition fees, court fees and
hotel fees however attorney's fees are not recoverable.
We want to take the time to THANK everyone for their
support during this process and a special THANK YOU to the property owners that
testified during the trial.
